These Terms of Service (the "Terms") apply when you visit jxairsoft.co.uk, use its features or place an order with JXAirsoft. In these Terms, "we", "us" and "our" mean JXAirsoft, and "you" means the person using the website or purchasing from us.

Please read these Terms together with our Privacy Policy, Refund Policy and Shipping Policy. Product-specific information shown on a product page also forms part of the contract for that product. Nothing in these Terms excludes or restricts rights that cannot lawfully be excluded or restricted.

1. Using this website

You must be at least 18 years old and have legal capacity to place an order. You must provide accurate, current and complete information when creating an account, contacting us or ordering. You are responsible for keeping your account credentials confidential, except where activity results from our failure to use reasonable care.

We may suspend or restrict access where reasonably necessary to protect the website, customers or third parties, or where we reasonably believe there has been unlawful, fraudulent or abusive use. This will not affect an accepted order or rights that have already arisen.

2. Product information and availability

We take reasonable care to keep product descriptions, dimensions, compatibility information, prices, images and availability accurate. Images are illustrative and colours or appearance may vary because of lighting and screen settings. Please check the product page and contact us before ordering if compatibility with a particular airsoft replica, thread, mount or accessory is important.

We may correct an error before accepting an order. If we discover a material error after acceptance, we will contact you and offer an appropriate solution, which may include confirming corrected information, offering an alternative or cancelling the affected item for a full refund.

3. Orders and contract formation

Placing an order is an offer to buy the products in your basket. An automated acknowledgement confirms that we received the order but does not itself mean that we accepted it. A contract is formed when we send an email expressly accepting the order or confirming dispatch, whichever occurs first.

Before acceptance, we may decline an order for a reasonable reason, including lack of availability, an obvious pricing or description error, failed payment authorisation, suspected fraud, a delivery restriction or a legal restriction. If payment has already been collected, we will refund the amount paid for the declined order.

4. Prices and payment

The price and currency shown at checkout apply to your order, subject to correction of an obvious error before acceptance. Delivery charges, taxes or other amounts collected by us will be shown before you place the order.

You confirm that you are authorised to use the payment method supplied and that the billing information is accurate. Payment may be authorised or collected before we accept the order. If we do not accept the order, any amount collected will be refunded.

5. Delivery and passing of risk

Delivery dates and transit times are estimates unless we expressly agree a fixed date. We will take reasonable steps to dispatch and deliver within the stated timeframe and will contact you if we become aware of a significant delay. Your statutory rights relating to late delivery are not affected.

Goods remain at JXAirsoft's risk until they come into the physical possession of you or a person you identify to receive them. If you independently commission a carrier that we did not offer or name, risk passes when the goods are delivered to that carrier, as provided by applicable law.

If an order is lost or damaged in transit before risk has passed to you, please contact us promptly. We will deal with the carrier and provide the remedy required by law. We may ask for reasonable evidence of damage or non-delivery, but this does not reduce your statutory rights.

6. Cancellations, returns and faulty goods

Our voluntary return arrangements and the procedure for exercising cancellation rights are set out in our Refund Policy.

If you are a UK consumer, the Consumer Rights Act 2015 requires goods to be of satisfactory quality, fit for a particular purpose made known to us and as described. It provides remedies where those requirements are not met. Nothing in these Terms, our policies or a product page limits those statutory rights.

7. Lawful purchase and use

You must purchase, possess, install and use products lawfully and responsibly. Product names or styling that refer to real equipment describe appearance or compatibility only unless the product page expressly states otherwise. Our products must not be modified or used for an unlawful purpose.

Some products may be subject to destination, carrier, import, possession or use restrictions. We may refuse or cancel an order where we cannot lawfully supply or deliver it. If we cancel for that reason, we will refund all sums paid to us for the affected item.

To the extent permitted by law, we are not responsible for loss caused by unlawful use, misuse, incorrect installation, failure to follow supplied instructions or unauthorised modification, except to the extent that the loss was caused by our breach of contract, negligence or failure to meet a statutory duty.

8. Intellectual property

The website and its text, photographs, graphics, videos, logos, layout and other content are owned by or licensed to JXAirsoft or the relevant rights holder and are protected by applicable intellectual-property laws.

You may use the website for personal, lawful shopping and information purposes. You must not copy, republish or commercially exploit protected content without permission, except where applicable law allows it.

9. Prohibited website use

You must not use the website to commit fraud or another unlawful act; introduce malware; interfere with the website or another user's access; attempt unauthorised access to systems, accounts or data; misrepresent your identity; or infringe the rights of JXAirsoft or a third party.

10. Shopify and third-party services

Our store is hosted by Shopify, which provides the ecommerce platform used to present products and process parts of your transaction. Your contract for products purchased from this store is with JXAirsoft, not Shopify.

The website may link to or integrate with third-party services. We are not responsible for a third party's independent content, availability or conduct. This does not exclude responsibility that the law places on us for services we select or use to fulfil our contract with you.

11. Privacy

We process personal information as described in our Privacy Policy. Shopify and other service providers may process information on our behalf to operate the store, take payment, prevent fraud, communicate with you and fulfil orders.

12. Reviews and feedback

If you submit a review or other feedback, you confirm that it is based on your genuine experience and does not contain unlawful, infringing or misleading content. You give us permission to display and reproduce it for operating and promoting the store. This permission does not transfer ownership of your content to us.

13. Website availability and corrections

We do not promise that the website will always be uninterrupted or error-free. We may maintain, update or temporarily restrict the website where reasonably necessary. We may correct website errors, but changes to these Terms or website content do not retrospectively remove rights under an order already accepted.

14. Our responsibility for loss or damage

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if, when the contract was formed, both you and we knew that it might happen.

We do not exclude or limit liability for death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of your statutory rights under the Consumer Rights Act 2015; defective products where liability cannot lawfully be excluded; or any other liability that cannot lawfully be excluded or limited.

When you purchase as a consumer, we are not responsible for business losses such as loss of profit, revenue, business, contracts, anticipated savings or business opportunity. Nothing in this section limits a remedy provided by these Terms, our policies or applicable law.

15. Events outside our reasonable control

We are not responsible for delay or failure caused by an event outside our reasonable control, provided that we take reasonable steps to reduce its effect and resume performance when reasonably possible. We will contact you if such an event materially affects your order. Your rights relating to significant delay or non-delivery are not affected.

16. Transfer, severability and waiver

We may transfer our rights or obligations under a contract to another organisation only where this does not reduce your rights. If a court or other competent authority finds part of these Terms unlawful or unenforceable, the remaining provisions will continue to apply. If we do not immediately enforce a right, that does not waive it.

17. Governing law and courts

These Terms and contracts between you and JXAirsoft are governed by the laws of England and Wales. If you are a consumer who normally lives in another part of the United Kingdom or another country, this choice does not deprive you of mandatory consumer protections provided by the law of the place where you normally live.

The courts of England and Wales will have jurisdiction. Consumers living in Scotland may also bring proceedings in the Scottish courts, and consumers living in Northern Ireland may also bring proceedings in the Northern Irish courts. Consumers outside the United Kingdom retain any mandatory rights concerning jurisdiction that apply in their place of residence.

18. Changes to these Terms

We may update these Terms by publishing a revised version on this page. Changes apply prospectively. The version in force when we accept your order will apply to that order unless a change is required by law or you and we expressly agree otherwise.
